Dispute Resolution

• Alternative Dispute Resolution

1. Representing and advising the clients before the counterparts and other related body/agency, to reach an amicable settlement;
2. Providing legal opinion, settlement proposal documents, and/or settlement agreements;
3. Acting as a mediator to find an amicable solution for the parties;

• Arbitration Tribunal

1. Representing the client before the arbitration tribunal, and all its proceedings;
2. Drafting, preparing, conveying arbitration documents, such as Request for Arbitration, Relief Sought, Answer, Reply, Rejoinder, Opening Statement and/or Closing Statement Presentation, Closing Statement (Kesimpulan);
3. Assisting and preparing interview and Affidavit for Witnesses and Experts;
4. Representing the client to conduct cross-examination of Witnesses and Experts presented before the tribunal;
5. Preparing and conveying Evidences, even for complex disputes such as EPCI Contract, Technical Assistance Contract, Gas Sales Agreement, Gas Transportation Agreement, etc.;

• Civil Cases

1. Representing the client before the Court, and all its proceedings;
2. Drafting, preparing, conveying court documents, such as Claim Application, Answer, Reply, Rejoinder, Closing Statement (Kesimpulan);
3. Assisting and preparing interview and Affidavit for Witnesses and Experts;
4. Representing the client to conduct cross-examination of Witnesses and Experts presented before the Court;
5. Preparing and conveying Evidences, and its List of Evidences;
6. Assisting client in suspension of debt payment obligation (Penundaan Kewajiban Pembayaran Utang – PKPU) and/or in bankruptcy;
7. Assisting and representing client in negotiation, mediation/conciliation, and court trial phase regarding industrial relations dispute;
8. Assisting and representing client in annulment process of an arbitration award, at District Court;

• Criminal Cases

1. Representing and accompanying client in examination and interrogation phase before the law enforcement institutions;
2. Ensuring the client’s rights and interests are fulfilled, even in detention;
3. If applicable, representing and accompanying client in pretrial review including preparing Pretrial Application, and its Evidences;
4. Representing and accompanying client in court examination which includes preparing for Objection Statement (Nota Keberatan/Eksepsi), presenting Defense Witness, and Defense Statement (Pledoi);
5. Representing and accompanying client in conducting Ordinary Legal Remedies, in appeal and/or cassation to the Supreme Court, which includes preparing the petition, and its supporting documents;
6. Representing and accompanying client in conducting Extraordinary Legal Remedies, in Reconsideration of a Judgement, which includes preparing the petition, and its supporting documents;
7. Assisting client in the Execution of the fine and confiscation relating to the Court Decision.
